The Overnight Desk · Legal
Privacy Policy
Effective date: October 1, 2026
This Privacy Policy explains what personal information The Overnight Desk ("we", "us", "our") collects, how we use it, and the choices you have. The Overnight Desk is a free pre-market investing newsletter about stocks, crypto and the economy, written for readers in the United States and sent every weekday at 6:00 AM ET. It is published by The Overnight Desk Team at theovernightdesk.com.
01Who we are
The Overnight Desk is operated by The Overnight Desk Team. For privacy purposes, we are the "controller" (or "business") responsible for your personal information.
- Email: desk@theovernightdesk.com
- Mail: 228 Park Ave S, #29976, New York, New York 10003, United States
Our newsletter and website are hosted on beehiiv, a newsletter platform. beehiiv processes subscriber data on our behalf as our service provider.
02What we collect
We collect only what we need to run the newsletter.
Information you give us
- Your email address when you subscribe.
- Anything you send us, such as replies to an issue, questions, corrections or survey answers.
- If we ever run a referral program with physical rewards, the shipping details needed to send a reward you claim.
- If we ever offer a paid tier, the billing details needed for it. Payments would be handled by a payment processor; we would not see or store your full card number.
Information collected automatically
- Sign-up details: the date, the page or link you subscribed from, and referral information (for example, which reader or campaign sent you).
- Email activity: whether you open an issue and which links you click. This uses standard tracking pixels and tracked links built into beehiiv.
- Device and connection information: IP address, browser type, device type, operating system and approximate location (city or region) derived from your IP address.
- Website cookies: our website on beehiiv uses cookies and similar technologies to keep the site working, remember your subscription status and measure traffic. See "Cookies and tracking" below.
We do not ask for sensitive information such as your Social Security number, financial account details or health information. Please do not send it to us.
03How we use it
- To send you the newsletter and any emails you signed up for, including welcome emails.
- To run and improve the newsletter, for example by seeing which topics and links readers find useful.
- To measure deliverability and remove inactive or invalid addresses, so our emails keep reaching inboxes.
- To answer your messages and feedback.
- To run a referral program, sponsorships or a paid tier, if and when we offer them.
- To prevent spam, abuse and fraud, and to keep our systems secure.
- To comply with the law, including email marketing laws, and to enforce our Terms of Service.
04Legal bases (EEA and UK readers)
If you are in the European Economic Area or the United Kingdom, we rely on these legal bases under the GDPR and UK GDPR:
- Consent: sending you the newsletter after you subscribe, and using non-essential cookies where consent is required. You can withdraw consent at any time by unsubscribing or changing your cookie settings.
- Legitimate interests: measuring opens and clicks to improve the newsletter, keeping our list healthy, preventing abuse and securing our service. We balance these interests against your rights, and you can object at any time.
- Contract: providing a paid subscription or referral reward, if we offer one and you sign up for it.
- Legal obligation: keeping records we are required to keep, such as unsubscribe requests.
05Who we share it with
We do not sell your personal information. We share it only in these cases:
- beehiiv, which hosts our newsletter and website, stores subscriber data, sends our emails and provides analytics.
- Other service providers that help us run the newsletter, such as email delivery, analytics, survey or payment providers. They may use your information only to provide services to us.
- Legal and safety reasons: when required by law, subpoena or court order, or to protect our rights, our readers or the public.
- Business transfers: if The Overnight Desk is sold, merged or transferred, subscriber data may move to the new owner, who must honor this policy or tell you about any changes.
06Cookies and tracking
Our website uses cookies, which are small files stored by your browser. Some are needed for the site to work. Others help measure traffic and how the site is used. Our emails contain tracking pixels and tracked links so we can see opens and clicks.
Your choices
- You can block or delete cookies in your browser settings. Some parts of the site may not work properly without them.
- You can stop open tracking by turning off automatic image loading in your email app.
- Where the law requires it, we or beehiiv will ask for your consent before setting non-essential cookies.
Do Not Track and Global Privacy Control
There is no common industry standard for "Do Not Track" browser signals, so we do not respond to them. We do treat a valid Global Privacy Control (GPC) signal as a request to opt out of any "sale" or "sharing" of your personal information, where required by law, for the browser or device that sends it.
07Ads, sponsors and affiliate links
The Overnight Desk may include sponsored sections, labeled ads, affiliate links and, in the future, a paid tier. When it does:
- Sponsored content and ads are always clearly labeled.
- Affiliate links are labeled next to the link. If you click one and buy something, we may earn a commission. The company you visit may use its own cookies to track that referral under its own privacy policy.
- If ads are ever personalized using information about your activity across other websites or services, that may count as "sharing" for cross-context behavioral advertising under California law. We do not do this today. If we start, we will update this policy first and give you a way to opt out.
08Unsubscribing
Every email we send has an unsubscribe link at the bottom, as required by the US CAN-SPAM Act. Click it and you will be removed from the newsletter. You can also email desk@theovernightdesk.com and ask us to remove you.
Unsubscribing stops our newsletter emails. We may keep your email address on a suppression list so we do not email you again by mistake.
09How long we keep it
- Subscriber data is kept while you are subscribed. We may remove addresses that have not opened our emails for a long time.
- After you unsubscribe, we keep only what we need to honor your opt-out (such as your email on a suppression list) and any records we are legally required to keep.
- Messages you send us are kept as long as needed to answer them and for our records, then deleted.
- Payment and tax records, if we ever offer a paid tier, are kept for as long as tax and accounting laws require.
You can ask us to delete your data at any time (see "Your rights").
10Security
We use reasonable technical and organizational measures to protect your information, and we rely on beehiiv and our other providers to maintain industry-standard security. No method of sending or storing data is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and regulators where the law requires.
11International transfers
Our service providers, including beehiiv, store and process data in the United States and possibly other countries. Members of The Overnight Desk Team may also access data from outside the United States. These countries may have different data protection laws than where you live.
When we transfer personal information from the EEA or UK, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or a provider's certification under the EU-US Data Privacy Framework and its UK extension, where available.
12Your rights
Wherever you live, you can:
- Unsubscribe from our emails at any time.
- Ask what personal information we hold about you.
- Ask us to correct or delete it.
Email desk@theovernightdesk.com from the address you subscribed with. We may need to verify your identity before acting on a request. We will not treat you differently for using your privacy rights.
13EEA and UK rights
If you are in the EEA or UK, you also have the right to:
- Access a copy of your personal information.
- Rectify inaccurate information.
- Erase your information ("right to be forgotten").
- Restrict how we use it.
- Object to processing based on legitimate interests.
- Data portability: receive your information in a portable format.
- Withdraw consent at any time, without affecting processing that already happened.
- Complain to your local data protection authority, or in the UK to the Information Commissioner's Office (ICO).
We will respond within one month, which may be extended where the law allows.
14California and other US state rights
If you live in California, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) gives you the right to:
- Know what personal information we collect, use and disclose, and the sources and purposes.
- Access a copy of your personal information.
- Delete your personal information, with some exceptions.
- Correct inaccurate personal information.
- Opt out of the "sale" or "sharing" of your personal information. We do not sell personal information, and we do not currently share it for cross-context behavioral advertising.
- Limit the use of sensitive personal information. We do not collect sensitive personal information for that purpose.
- Non-discrimination for using any of these rights.
Categories we collect: identifiers (email address, IP address), internet or network activity (opens, clicks, website use, device information), approximate geolocation, and, only if you provide it, commercial information (a paid subscription or referral reward) and the contents of messages you send us. We collect these from you, your device and beehiiv, for the purposes listed in "How we use it", and disclose them only to the recipients listed in "Who we share it with".
Residents of other US states with consumer privacy laws (such as Colorado, Connecticut, Virginia and others) may have similar rights, including the right to appeal if we deny a request. To appeal, reply to our decision or email us with "Appeal" in the subject line.
To make a request, email desk@theovernightdesk.com. You may use an authorized agent, who must show us your written permission. We will respond within 45 days, which may be extended where the law allows.
15Children
The Overnight Desk is written for adults and is not directed to children. We do not knowingly collect personal information from children under 13, in line with the US Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from anyone under 16 without the consent required by law, and we do not sell or share the personal information of anyone under 16.
If you believe a child has subscribed, email desk@theovernightdesk.com and we will delete their information.
16Changes to this policy
We may update this policy from time to time. When we do, we will change the effective date at the top. If the changes are significant, we will tell subscribers by email or with a notice on our website before they take effect.
